Terms of Service

Because you are downloading ThryveFit from the Apple App Store, you acknowledge and agree that:

• These Terms are concluded between you and ThryveFit, Inc. only, and not with Apple, Inc. (“Apple”).
• ThryveFit, not Apple, is solely responsible for the App and the content thereof.
• Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.
• In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you (if applicable); and, to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App.
• Apple is not responsible for addressing any claims you have or any claims of a third party relating to the App or your possession and use of the App.
• Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

• Age Requirement: You must be at least 18 years old (or the age of majority in your jurisdiction) to use ThryveFit and purchase a subscription.
• Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

ThryveFit offers a premium auto-renewing monthly subscription tier:

• Pricing: The subscription is priced at $9.99 USD per month (plus applicable taxes where required by law).
• Billing: Payment will be charged to your Apple ID account at confirmation of purchase.
• Auto-Renewal: Your subscription automatically renews each month unless it is canceled at least 24 hours before the end of the current billing period.
• Account Charging: Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of $9.99/month.
• Managing and Canceling Subscriptions: You can manage and cancel your subscriptions by going to your Apple ID Account Settings on your device after purchase. Deleting the App does not automatically cancel your subscription.
• Free Trials (if applicable): Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription.
• Price Changes: We reserve the right to adjust subscription pricing with prior notice, effective at the start of the next subscription cycle.

• Not Medical Advice: ThryveFit is designed for informational, educational, and fitness tracking purposes only. We are not a medical organization, and our staff cannot give you medical advice or diagnosis.
• Consult a Doctor: Always consult your physician or healthcare provider before starting any fitness program, weight loss regimen, or diet plan, especially if you have pre-existing health conditions.
• Assumption of Risk: You understand and agree that participation in fitness activities carries inherent risks of physical injury. You use ThryveFit and engage in workouts at your own sole risk.

• Grant of License: Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on your personal Apple-branded device for personal, non-commercial purposes.
• Restrictions: You agree not to copy, reverse-engineer, decompile, disassemble, modify, or create derivative works of the App, or attempt to extract its source code. All rights not expressly granted are reserved by ThryveFit, Inc.

You agree not to use the App to:

• Violate any applicable local, state, national, or international law.
• Harass, threaten, bully, or abuse other users or ThryveFit staff.
• Upload or transmit viruses, malicious code, or unauthorized automated scripts.
• Attempt to bypass, disable, or interfere with security-related features of the App.

We reserve the right to suspend or terminate your account and access to ThryveFit immediately, without prior notice or liability, if you breach any provision of these Terms or fail to pay applicable subscription fees.

THE APP IS PROVIDED ON AN “AS-IS” AND “AS-AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, THRYVEFIT DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THRYVEFIT, INC., ITS DIRECTORS, EMPLOYEES, OR PARTNERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP.
